1 Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you or the entity you represent ("Merchant", "Customer", "User", or "you") and Oasis India IT Store ("Company", "we", "us", or "our"), governing your access to and use of Hiba Technologies, Oasis Table, our website (oasispos.in), desktop client applications, mobile extensions, POS hardware peripherals, and integrated communication services.

By purchasing, downloading, installing, subscribing to, or accessing any part of our software or hardware solutions, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our services.

2 Description of Services

Hiba Technologies provides an integrated retail and dining technology ecosystem designed for high-speed counter billing and business management:

• Retail & Supermarket POS: High-speed barcode checkout, GST auto-calculation, batch inventory control, weighing scale synchronization, and customer credit (Khata) tracking.
• Restaurant & Dining System: Floor plan table management, Captain app ordering, Kitchen Order Ticket (KOT) printing, and table split-billing.
• Hardware Counter Solutions: Certified 15.6" touch POS terminals, 3" auto-cut thermal printers, 2D QR/barcode scanners, cash drawers, and barcode label printers.
• Transactional Communication & WhatsApp Integration: Automated transmission of digital receipts, e-invoices, and order alerts via Meta's WhatsApp Business Platform.

3 Account & Administrator Responsibilities

To utilize Hiba Technologies, merchants must register an authorized administrator account and provide accurate, current, and complete business information (including GSTIN where applicable).

• You are solely responsible for maintaining the confidentiality of your account credentials, license keys, and API access tokens.
• You are responsible for all activities and transactions conducted under your administrator and cashier accounts.
• You agree to notify us immediately of any suspected unauthorized access or security breach at support@oasispos.in.

4 Permitted Use & Prohibited Conduct

You agree to use our software and services solely for legitimate business operations in compliance with all applicable laws in India.

You agree NOT to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of our desktop or cloud software.
• Use the software for fraudulent transactions, tax evasion, fake invoicing, or money laundering activities.
• Circumvent license checks, DRM controls, or hardware dongle/serial verifications.
• Resell, sublicense, lease, or distribute the software to unauthorized third parties without our prior written authorization.

5 WhatsApp Business Platform Integration Terms

When enabling the Meta / WhatsApp Business Platform integration within Hiba Technologies, you agree to comply with:

• The official WhatsApp Business Messaging Policy and Meta Developer Terms.
• Transmitting ONLY authorized transactional communications (such as requested tax invoices, payment receipts, order confirmations, and customer-initiated service queries).
• Strictly refraining from sending unsolicited spam messages, deceptive marketing broadcasts, or harassment to consumers.
• Respecting consumer opt-out requests and honoring data deletion requests in accordance with our Data Deletion Instructions.

6 Billing, Licenses & Payments

Software licenses and subscription packages are provided under the terms agreed upon during purchase:

• License Scope: Each software license is bound to the number of billing counters and branches specified on your commercial invoice.
• Taxes: All fees are subject to applicable Goods and Services Tax (GST) under Indian statutory law.
• Annual Maintenance & Upgrades: Software updates, regulatory GST rate changes, and cloud sync services require an active subscription or Annual Maintenance Contract (AMC).

7 Hardware Supply, Testing & Warranty

Hardware supplied by Oasis India IT Store (such as thermal printers, touch terminals, barcode scanners, and weighing scales) is pre-configured and tested for 100% plug-and-play compatibility with Oasis POS.

• Warranty Coverage: Certified hardware comes with the manufacturer warranty period specified on your invoice (standard 1-Year replacement/on-site warranty for qualified products in Chennai & Tamil Nadu).
• Exclusions: Warranty does not cover physical drops, liquid spills, power surge/voltage fluctuations without adequate UPS protection, or unauthorized third-party tampering.

8 Service Availability & Offline Continuity

Oasis POS is engineered with an offline-first local database architecture. Cashiers can continue billing, scanning barcodes, and printing physical receipts even during internet outages.

Cloud synchronization, automated WhatsApp messaging, and remote multi-branch dashboards require active internet connectivity and third-party infrastructure (such as Meta Graph API servers), which may experience occasional downtime beyond our reasonable control.

9 Intellectual Property Rights

All software source code, database architectures, compiled binaries, user interfaces, branding, logos, trademarks, and documentation related to Hiba Technologies and Oasis Table are the exclusive intellectual property of Oasis India IT Store.

Nothing in these Terms grants the Merchant any ownership or proprietary right in our intellectual property, except for the limited, non-exclusive, non-transferable license to use the software in accordance with your purchased plan.

10 Limitation of Liability & Tax Compliance Disclaimer

Merchant Statutory Compliance Responsibility: The Merchant is solely responsible for verifying the accuracy of product pricing, HSN/SAC codes, CGST/SGST/IGST tax slabs, customer invoices, and statutory tax filings generated using the software.

To the maximum extent permitted by law, Oasis India IT Store shall not be liable for any indirect, incidental, punitive, or consequential damages, loss of business revenue, data loss, or tax penalties arising out of the use or inability to use the software or hardware peripherals. Our total liability for any claim shall not exceed the amount paid by you for the software license in the preceding twelve (12) months.

11 Suspension & Termination

We reserve the right to suspend or terminate your software license or integration services immediately upon written notice if:

• You commit a material breach of these Terms, our Privacy Policy, or Meta Platform Policies.
• You fail to pay subscription renewal or AMC fees when due.
• We are required to do so by a court of competent jurisdiction or statutory regulatory authority.

12 Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the substantive laws of the Republic of India.

Any legal dispute, suit, or proceeding arising out of or related to these Terms or our services shall be subject to the exclusive jurisdiction of the competent civil courts situated in Chennai, Tamil Nadu, India.
